The death of Dylan Blankenship, age 6 months
Wednesday, December 9, 2009
St. Louis Post-Dispatch: As the Missouri Supreme Court prepares to hear arguments in a case that challenges the state’s $350,000 limit on pain and suffering in medical negligence cases, Tony Messenger tells the story of a couple whose six-month-old child died from an infection that emergency room doctors missed, despite obvious symptoms. A jury awarded the parents $6 million, but the award was reduced under the state limit. California law limits awards for noneconomic damages, such as pain and suffering, in medical negligence cases to $250,000.
