• Law professors make the case against medical negligence award caps Tuesday, November 17, 2009

    Cleveland Plain Dealer:  In an opinion piece, Case Western Reserve University law professors Max Mehlman and Dale Nance make the case against caps on damages for medical negligence and the creation of “health courts” to hear negligence cases.  “The simple truth is that any reduction in the risk of civil liability would remove a critical safety incentive,” they write.  “Caps on recoverable damages may be comforting to the medical establishment and its insurers, but they punish those who least deserve it — seriously injured patients with clear-cut cases.”
