U.S. Supreme Court rules arbitrators get to decide whether arbitration is fair

National Law Journal: The U.S. Supreme Court “made it more difficult for consumers and employees to challenge the fairness of arbitration agreements in court,” reports Marcia Coyle. The 5-4 ruling in Rent-A-Center, West v. Jackson “greatly limits the ability of consumers and employees to challenge the fairness of arbitration agreements,” according to a co-counsel for the defendant.
