When medical devices fail: “Everybody is paying now except the companies”

Raleigh News & Observer: Sarah Avery writes about the impact of a 2008 U.S. Supreme Court ruling that makers of heart pumps, artificial joints, implants and other medical devices cannot be sued if their products injure patients, as long as those products have been approved by the Food and Drug Administration. “The question is, who is going to pay when a patient is injured?” attorney Allison Zieve told Avery. “”Now the answer is, the patient pays, which also means Medicare and Medicaid, disability and Social Security insurance – everybody is paying now except the companies.”
